Rickard-Simms – Private Prosecution

On 20 April 2016 Jayden Rickard-Simms suffered a serious head injury in a workplace accident at Grenada North near Wellington. Jayden was in intensive care for 14 days following the fall and is still affected by it. In April 2018, Jayden brought a private prosecution against ENGIE, Hall’s Refrigerated Transport Limited and Goodman Fielder under the Health and Safety at Work Act 2015.

ENGIE, Hall’s Refrigerated Transport Limited and Goodman Fielder have taken steps to improve their health and safety procedures since the accident. They have discussed these steps with Jayden and given him an undertaking in respect of them. The parties will be attending a restorative justice conference which will provide ENGIE, Hall’s Refrigerated Transport Limited and Goodman Fielder with the opportunity to, in person, apologise and express their regret for what occurred and the impact this has had on Jayden.

In all the circumstances, Jayden has decided to withdraw the charges and has obtained the leave of the Court to do so. Jayden is satisfied that the actions taken by the three companies addresses the public interest in this prosecution.
