We have extensive experience with commercial and property litigation. Examples of
the types of claims we have handled include:
- A range of disputes concerning sale of land or businesses involving a variety of
issues from disputed cancellation of contract, specific performance, mortgagee sales,
removal of caveats, rights of way etc. - Leading Court of Appeal decision in Roseneath Holdings v Grieve ([2004]
2 NZLR 168) regarding interim injunctions in which our clients successfully obtained
injuctions against a vendor and mortgagee to restrain attempted mortgagee sale pending
application for specific performance. Court found arguable case of Land Transfer
Act fraud. - Advising on various partnership or shareholder disputes together with related valuation
and departure issues. - Various landlord/tenant disputes and enforcement issues.
- Acting and advising various tax payers in relation to tax disputes (involving GST,
PAYE, non-resident withholding tax, penalties and interest and associated negotiations
with the IRD to obtain resolution). - Acting for a property manager in a multi-party claim involving alleged misrepresentation
and breach of the Fair Trading Act following the sale of a leased commercial property. - Acting for the owner of a racing stud in dispute regarding ownership/partnership
issues. - Acting on a major claim against a bank and a solicitor following non-settlement
of a property transaction and a purported termination of a settlement deed.
