Hilary Tse
Associate
Hilary completed a BA in Chinese and an LLB at Victoria University of Wellington in 2006 and was admitted as a Barrister and Solicitor in 2007. She has worked at Parker & Associates as a law clerk since 2002 and now as a solicitor.
Since working at Parker & Associates, Hilary has been heavily involved in construction disputes, including leaky building claims and claims under the Construction Contracts Act 2002. She has also worked on subrogated recovery actions for insurers, defamation cases, contractual disputes and has assisted on a number of large relationship property files. This work has involved:
- Leaky building disputes involving both multi unit and single dwelling houses in both the High Court and through the Weathertight Homes Tribunal.
- Providing advice to various Body Corporates in relation to internal governance issues, including advice on the rights and obligations of Body Corporates and owners under the Body Corporate rules and the Unit Titles Act 1972.
- Acting for insurers in subrogated recoveries and/or defences on a number of claims including fire claims, defective workmanship claims and trespass/land rights cases.
- Assisting on various property litigation matters including advice on contractual disputes, exercising rights of first refusal and options to purchase, claims of adverse possession and disputes involving easements and rights of ways.
- Assisting on relationship property cases including advice on intestacy issues, de facto relationship issues and the Property (Relationships) Act 1976 and the classification of property as relationship or separate property.
