Senior Associate
Stuart joined the firm as a Senior Associate in September 2009.
Commercial Litigation
Stuart specialises in commercial litigation and dispute resolution.
He has appeared as counsel in the High Court and District Courts, and as junior counsel in the Court of Appeal.
He advises clients on a broad range of complex commercial disputes, with particular experience in trade practices (competition and fair trading), construction, public law and general contract law disputes.
Stuart’s recent experience includes:
- Senior Associate/acting and advising on several major multi-unit leaky building claims;
- Commerce Commission v Telecom (“0867”) from 1999-2009;
- Claims under s9, Fair Trading Act arising out of acquisition of company;
- Harrington Ventures v Tricom Equities – a claim in respect of alleged unauthorised foreign exchange trading (junior counsel for Tricom);
- Assisting commercial fishers on claims for interim orders under the Judicature Amendment Act;
Croft v PwC – a pensions dispute under partnership agreement (junior counsel for PwC); - Acting for an NGO in commercial mediation relating to restraint of trade issues;
- Advising a multi-national energy company on contract breach and frustration issues arising out of oil rig construction contract;
- Advising multi-national hotels company in respect of construction litigation, including obtaining Pickwick injunctive relief to protect settlement funds;
Employment
Stuart has a particular breadth and depth of experience in resolving employment disputes. His employment practice includes:
- Representing clients at Employment Court, Employment Relations Authority and mediation;
- Drafting and reviewing collective and individual employment agreements and employer policies;
- Collective labour environments;
- Large-scale company acquisitions and restructurings;
- Discipline and dismissals;
- Post employment conduct;
- Advising on all workplace related legislation, including the Employment Relations Act, Holidays Act, Protected Disclosures Act, Parental Leave and Employment Protections Act, Kiwisaver Act, Human Rights Act, Health and Safety in Employment Act and the Privacy Act.
Privacy and Information Law
Stuart has advised on compliance issues relating to the Privacy and Official Information Acts. He has also assisted with the resolution of information requests from both sides of requests.
General
Stuart joined the firm from Chapman Tripp where he worked for 11 years, and as a Senior Solicitor from 2005. He has worked at the vanguard of employment law in the public sector, as well as advising major private sector companies, and individuals. He has achieved great results, while understanding that employment is a practice area where the issues are often commercially sensitive and deeply personal.

Stuart has given numerous client presentations and workshops on employment law issues. He has also contributed numerous employment related articles to corporate and HR magazines.
