Stuart Dalzell is a Partner in the firm and has over 20 years' experience in commercial litigation and dispute resolution matters.

Stuart's practice is very broad but his focus is on commercial law, product liability/class actions and employment law.

Stuart prides himself on developing a high performance culture within his team with an emphasis on client service and practical commercial resolutions.

While Stuart has appeared as counsel at most levels of the Court system, often his skills are called upon by clients wishing to avoid or minimise their court exposure. In those cases, it is Stuart's strategic advice that facilitates the client's ability to negotiate a well leveraged deal from what could otherwise be a costly and lengthy dispute.

Stuart has a BA/LLB(Hons) from Auckland University and worked at a major national firm for 10 years before joining Parker & Associates, becoming a partner in 2014.

Stuart's recent highlight's include:
  • Successfully represented vendors and purchasers in litigation regarding purchase and sale of leaky buildings, including Anderson v DeMarco [2020] NZHC 2979 (seller misrepresented condition of property ordered to return deposit paid); [2020] NZHC 3490 (damages, interest, expert and legal costs).
  • Successfully represented judgment creditors in the bankruptcy of Eugene DeMarco: Anderson v DeMarco [2021] NZHC 1757.
  • Successfully represented client homeowners in obtaining representative (class) action against James Hardie: Cridge v Studorp [2017] NZCA 376, leave to appeal declined: [2017] NZSC178.
  • St Paul's Apartments: Representing the Body Corporate and owners in one of the largest multi-unit complex claims to come before the Weathertight Homes Tribunal
  • Advising the claimants in a successful appeal from a decision of the Weathertight Homes Tribunal, resulting in the restoration of 40 units to a large multi-unit leaky building claim.
  • Extensive experience in defective building claims including several large multi-unit complex claims (e.g. St Paul's, Stadium Gardens Apartments).
